These terms apply from the date this version was published in the app. Using SMART SEAMEN means you accept them.

1. Purpose and scope

SMART SEAMEN is a private workspace for bulk-carrier seafarers. It helps you keep profile details, certificates, sea-service records, ship particulars, draft surveys, reports and maritime calculations in one place, and gives approved members access to shared features such as posts, AI Assistance, the world map and optional position sharing.
The app is a working aid. It is not an approved navigational, cargo or statutory system, it is not type-approved, and it is not a replacement for your company's Safety Management System, the master's or a senior officer's instructions, official charts and publications, class or flag-approved forms, or the advice of a competent person.

2. Membership and approval

An account is created by you and then reviewed by the owner. Until the owner approves it you can sign in but you will see the approval screen instead of the workspace. On approval you are issued a member identifier.
The owner may approve, decline, suspend or remove a membership at his discretion, including where an account appears to be shared, false, dormant or misused. Membership is personal to you and may not be transferred, sold or shared.

3. Your account

Keep your sign-in details, your device and, where you use it, your App Lock code private. You are responsible for everything done through your account. Tell the owner promptly if you believe someone else has access to it.
The information you give at sign-up - name, rank and seafarer document details - must be your own and correct. Your seafarer document number is stored only as an irreversible hash together with the last four digits; the full number is never stored, never displayed and never visible to other members.

4. Calculations are an aid, never the authority

Every calculator in the app - draft survey, stability and hydrostatics, compass error, celestial and coastal navigation, ETA, passage, consumption, cargo and every report built from them - produces a result from the numbers and assumptions you enter.
You are responsible for entering the correct figures, choosing the correct method, checking the units and the sign of every correction, and reviewing the result before it is used. Before any operational, commercial or statutory use, verify the result independently against the vessel's approved documents, the ship's own tables and instruments, and the situation on board. The owner accepts no responsibility for decisions taken on the basis of a figure produced by the app.

5. Your records

Records you create belong to you. Most of them are held in this browser on this device, and some are held on the cloud service the app uses so that they can be recovered or used across your devices.
Storage in a browser is not permanent. It can be cleared by you, by the device, by the browser itself, or lost if the device is lost, reset or damaged. Export a backup regularly from Settings and keep it somewhere safe. A backup file may contain sensitive personal and employment information, so treat it as a private document.
The owner does not guarantee that any record can be recovered and is not liable for records that are lost, corrupted or unreadable.

6. AI Assistance

AI Assistance is optional and is enabled per member by the owner. Where it is enabled, a usage allowance may be applied and may be changed or withdrawn at any time.
What you type into AI Assistance, together with any file or image you attach to it, is sent to an external AI service to produce an answer. Do not send anything you are not entitled to disclose - company confidential material, crew personal data, commercial documents or anything restricted by your employer.
AI answers are generated text. They can be wrong, incomplete or out of date, they are not professional, legal, medical or regulatory advice, and they must never be used as the basis for a navigational, cargo, stability or safety decision without independent verification.

7. Position sharing

Position sharing is off by default. When you turn it on, your current position is sent to the app's server and shown to other members who also have sharing turned on and are within the published radius. Nothing is shown to a member who is not sharing.
Your shared position is short-lived: it expires automatically after a short period, and it is removed when you turn sharing off, sign out or stop the app. You should not turn sharing on where your company, charterer or flag administration restricts the disclosure of the vessel's position, and you are responsible for compliance with any such restriction.

8. Vessel information from public sources

Where the app displays vessel movements or particulars taken from a public vessel-tracking service, that information comes from third parties, is provided as-is, may be delayed, incomplete or wrong, and must never be used for collision avoidance, navigation or any other safety-critical purpose.

9. Acceptable use

You agree not to: use the app unlawfully or in breach of your employer's rules; upload unlawful, abusive, defamatory or infringing material; upload another person's personal data without a proper basis; attempt to access another member's account or data; probe, disrupt, overload or circumvent the app's security, limits or approval controls; reverse engineer, decompile or copy the app or its content except where the law expressly allows it; or use the app or its output to build a competing product.
Content you post to the shared feed may be seen by other approved members and by the owner, and may be removed at any time.

10. Availability and changes

The app is provided on an as-is and as-available basis. Features may be added, changed, limited or withdrawn, and services it depends on may be interrupted or discontinued. No particular level of availability, accuracy or performance is promised.
These terms may be updated. The current version is always the one shown in the app, and continued use after a change means you accept it.

11. Limitation of liability

To the fullest extent the law allows, the owner is not liable for any indirect or consequential loss, or for loss of profit, revenue, hire, cargo, employment, data or records, arising out of the app or from any calculation, AI answer, map, position, vessel information or record it produces or fails to produce.
Nothing in these terms limits liability that cannot lawfully be limited.

12. Ending your membership

You may stop using the app at any time and may ask for your account to be closed. The owner may end a membership where these terms are broken or where the app is discontinued. Export your backup before your access ends - once an account is removed its cloud records may be deleted and cannot be restored.
